On March 9, 2022, the Government adopted Decree No. 312 “On the introduction on a temporary basis of a permit procedure for the export of certain types of goods outside the territory of the Russian Federation.”

The Decree determines the licensing procedure for the export of certain types of industrial products outside the territory of the Russian Federation to the territory of the member states of the Eurasian Economic Union, the Republic of Abkhazia and the Republic of South Ossetia (the list of TN VED codes is attached).

The requirement for an export permit procedure does not apply to goods produced in Russia and having a certificate of origin in the ST-1 form. In the near future, the list of documents that can be used to confirm Russian origin will be expanded.

In accordance with the resolution, the Ministry of Industry and Trade of Russia prepared the Procedure for issuing permits (the full text of the document is in the appendix).

According to the Procedure, permits for the export of industrial products will be issued by the relevant departments of the Ministry of Industry and Trade of Russia on the basis of an application by a legal entity or an individual entrepreneur, submitted in paper form or through the state information system of industry (if technically possible in GISP).

The Procedure also provides for the application of additional information for certain product groups, for example, agricultural, food and road construction machinery, machine tool products and heavy machinery, etc.

The application and documents received by the Ministry are registered on the day of receipt and within 1 working day are submitted for consideration to the relevant department.

The application is verified within 5 business days. In case of incompleteness of documents and (or) their unreliability, a notification is sent to clarify the information. The grounds for refusing to issue an export permit are the failure by the applicant to eliminate the identified violations on time and (or) the presence of a critical shortage of industrial products in Russia. If the procedure is followed, the relevant department sends the export permit to the applicant.
