The Ministry of Industry and Trade collects applications for the distribution of 30% of the tariff quota for the export of waste and scrap of ferrous metals

Until the end of 2022, Russia will have a tariff quota for the export of ferrous scrap and waste from the EAEU. This decision was made as part of a consistent policy to regulate the export of metal from the country, which is necessary for the production of industrial products, and is aimed at providing domestic metallurgical enterprises with strategic raw materials.

The rules for distributing this tariff quota among participants in foreign trade activities were approved by Decree of the Government of the Russian Federation No. 1358 dated July 30, 2022. In accordance with these Rules, the Ministry of Industry and Trade of Russia has already distributed 70% of the tariff quota for the export of waste and scrap of ferrous metals outside the EAEU according to the indicators of each exporter of these products according to the following formula: the volumes of ferrous metal waste and scrap exported by this exporter for 2021 from each constituent entity of the Russian Federation, multiplied by the coefficients for the constituent entities established by these Rules. At the same time, the remaining 30% of the quota will be distributed by the Ministry of Industry and Trade of Russia according to applications submitted by participants in foreign trade activities to the Ministry independently.

To receive this part of the volume of the tariff quota, an exporter who exported waste and scrap of ferrous metals outside the EAEU from January 1, 2021 to June 30, 2022 must submit the following documents to the Ministry of Industry and Trade of Russia by August 15, 2022 inclusive:

a) an application for receiving a part of the volume of the tariff quota, indicating the quantity of goods (in kilograms) intended to be exported outside the EAEU, within the period established by paragraph 1 of Decree of the Government of the Russian Federation No. 1358 dated July 30, 2022, as well as the term for such delivery;

b) copies of the signed foreign trade agreement (contract), annexes, and (or) specifications, and (or) acceptance certificates, and (or) additions to it, certified by the head of the organization, substantiating the quantity of goods (in kilograms) specified in the application;

c) copies of the signed agreement (contract), annexes, and (or) specifications, and (or) acceptance certificates, and (or) additions to it, certified by the head of the organization, confirming the shipment of waste and scrap of ferrous metals to the backbone organizations of the Russian economy in accordance with the criteria or additional grounds approved by the Government Commission for Improving the Sustainability of the Development of the Russian Economy, and (or) legal entities established in accordance with the legislation of the Russian Federation and included in the group of entities of a backbone organization in accordance with the provisions of Article 9 of the Federal Law “On the Protection of competition”, in the period from August 1, 2021 to July 31, 2022 in the amount of not less than the amount of goods specified by the participant in foreign trade activities in the application for receiving a part of the volume of the tariff quota;

d) information on registration with the tax authority or on the state registration of the applicant as a legal entity.

Failure to submit these documents, or submission of incomplete or false information in these documents, as well as termination or suspension of the validity of one or more documents are grounds for refusing to allocate a special quota to a participant in foreign trade activities.

Applications for receiving a part of the volume of the tariff quota (30%) must be sent before August 15, 2022. They can be sent by mail to the Director of the Department of Metallurgy and Materials of the Ministry of Industry and Trade of Russia Mashkautsan S.A. at the address: 125039, Moscow, Presnenskaya nab., 10, building 2. Applications can also be submitted to the Expedition of the Ministry of Industry and Trade of Russia at the same address: Moscow, Presnenskaya nab., 10, building 2 ( Tower 2).

Based on the results of consideration of received applications, the list of enterprises that have been allocated a part of the tariff quota (30%) will be approved by order of the Ministry of Industry and Trade of Russia.
