On the procedure for issuing certificates of origin of goods

The Ministry of Industry and Trade of Russia, together with the Chamber of Commerce and Industry, has developed special rules for issuing certificates of origin of goods to Russian exporters. This measure simplifies the procedure for obtaining permits established by Decrees of the Government of the Russian Federation of March 9, 2022 No. 311 and 312.

Taking into account the changes introduced by Decree of the Government of the Russian Federation of March 17, 2022 No. 390, in addition to the ST-1 certificate, other types of certificates of origin of goods can also be used as documents confirming the Russian origin of goods:

  • ST-2 forms
  • ST-3 forms
  • EAV forms
  • general form
  • shape “A”.

Such certificates of origin are used both for submission to Russian customs authorities (in the form of a paper or electronic copy) for the implementation of Decrees No. 311 and No. 312, and for submission to customs authorities abroad.

At the same time, if there is no need to obtain the certificates listed above, the exporter can obtain a specialized certificate of form ST-1 exclusively for Russian customs authorities for Russian goods included in Decrees No. 311 and No. 312 exported to foreign countries, including not related to the CIS member states.

In addition, in order to provide support to participants in foreign economic activity, until December 31, 2022, ST-1 certificates for Russian customs authorities will be issued free of charge and with minimal time costs.

FEA participants are not required to re-examine the origin in order to obtain ST-1 certificates for customs authorities in the case of:

– availability for the declared goods of the act of examination of determining the country of origin for the issuance of certificates of origin of goods form ST-1 valid for up to one year;

– the presence of an examination certificate for determining the country of origin of goods for the purpose of obtaining certificates of origin of goods (of any form other than form ST-1) and the coincidence of the criterion of origin applied to the claimed product specified in such an act with the criterion of origin established by the Rules dated November 20, 2009;

– the presence for the declared product of a valid certificate of origin of the goods of the ST-1 form, issued as part of the implementation of the Decree of the Government of the Russian Federation of July 17, 2015 No. 719 “On confirmation of the production of industrial products on the territory of the Russian Federation”;

– the presence of documents in relation to the declared goods confirming the fulfillment of the origin criterion – “goods wholly manufactured in the Russian Federation”, established by the Rules of November 20, 2009

In the absence of these conditions, an examination of the origin will be carried out, and its payment will be calculated based on the minimum possible number of expert hours spent on the examination.
